| DECISION & ORDER ON MOTION |
Motion by the appellant pro se on an appeal from an order of the Supreme Court, Kings County, dated July 13, 2010, inter alia, to waive the requirements of 22 NYCRR 670.10.2(f) regarding certification of the appellant's appendix.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to waive the requirements of 22 NYCRR 670.10.2(f) regarding certification of the appendix on appeal is granted on condition that on or before March 31, 2011, the appellant serve and file a supplemental appendix containing the following material (1) notice of cross motion of Allen E. Kaye, Allen E. Kaye, P.C., and Harvey Shapiro dated October 28, 2010, and Exhibits B, C, and D annexed to that cross motion, (2) notice of cross motion of Jack Gladstein dated October 28, 2010, and Exhibits B, C, and D annexed to that cross motion, and (3) notice of cross motion of Bernard Rostanski; and it is further,
ORDERED that the motion is otherwise denied.
