| DECISION & ORDER ON MOTION |
Motion by the appellant-respondent on an appeal and cross appeal from an order of the Supreme Court, Kings County, dated September 18, 2009, to dismiss the cross appeal on the ground that the respondents-appellants have failed to pay one-half the cost of printing the joint record on appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied on condition that on or before March 8, 2011, the respondents-appellants pay the appellant-respondent the sum of $4,483.66, representing one-half the cost of printing the joint record on appeal, and file proof of payment with the Court.
