| DECISION & ORDER ON MOTION |
Motion by the respondent to dismiss an appeal from an order of the Supreme Court, Nassau County, dated July 7, 2009, on the ground that the appellant's supplemental record is inadequate.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied on condition that on or before March 15, 2011, the appellant serves and files a second supplemental record containing the affidavit of Karen Finnegan, dated May 15, 2009; and it is further,
ORDERED that on the Court's own motion, the respondent's time to serve and file a brief is enlarged until April 1, 2011, and the respondent's brief must be served and filed on or before that date.
