DECISION & ORDER ON MOTION

Motion by Darren M. Shapiro, Esq., assigned counsel for the appellant on an appeal from an order of the Supreme Court, Suffolk County, dated October 5, 2009, to be relieved on the ground that the appellant is no longer interested in pursuing the appeal. By order to show cause dated January 11, 2011, the parties or their attorneys were directed to show cause before this Court why an order should or should not be made and entered relieving the assigned counsel for the appellant and dismissing the appeal in the above-entitled proceeding as abandoned, and assigned counsel's motion was held in abeyance in the interim.

Upon the papers filed in support of assigned counsel's motion and no papers having been filed in opposition or in relation thereto, and upon the order to show cause and no papers having been filed in response thereto, it is

ORDERED that the motions are granted; and it is further,

ORDERED that the appeal is dismissed, without costs or disbursements.
