| DECISION & ORDER ON MOTION |
Motion by the appellant pro se to recall and vacate a decision and order on motion dated September 8, 2010, which vacated a decision and order on motion dated July 16, 2010, granting the appellant leave to serve and file a supplemental brief on an appeal from an order of the Supreme Court, Kings County, dated July 27, 2009.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted, the decision and order on motion of this Court dated September 8, 2010, which vacated leave to file a supplemental brief, is recalled and vacated, the decision and order on motion of this Court dated July 16, 2010, which granted the appellant's motion for leave to serve and file a pro se supplemental brief, is reinstated, and the appellant shall file nine copies of the pro se supplemental brief and serve one copy on the District Attorney on or before April 18, 2011.
