DECISION & ORDER ON MOTION

Motion by the appellant pro se on an appeal from an order of the Supreme Court, Westchester County, entered July 29, 2010, for leave to proceed on the original papers and/or to exclude certain exhibits from the record, or alternatively, inter alia, to dispense with the reproduction of trial exhibits.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to dispense with the reproduction of the trial exhibits is granted, and the appellant shall file a list of the exhibits and a brief description of each exhibit upon perfection of the appeal; and it is further,

ORDERED that the branch of the motion which is to exclude certain exhibits from the record is denied; and it is further,

ORDERED that the motion is otherwise denied with leave to renew on or before March 30, 2011, upon proper papers, including the appellant's affidavit setting forth the appellant's full financial situation including all assets, specifically the value of all real property owned by the appellant and the equity in the real property, and personal property, as well as any and all sources of income and expenses.
