Motion by the appellant for leave to appeal to the Court of Appeals from a decision and order of this Court dated December 21, 2010, which determined an appeal from a judgment of the Supreme Court, Kings County, entered April 10, 2009, and to waive the motion filing fee.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is to waive the motion filing fee is granted; and it is further,
ORDERED that the branch of the motion which is for leave to appeal to the Court of Appeals is denied.
