The People of the State of New York, Respondent, v Douglas Brennan, Appellant.

Motion by appellant to vacate an order of this court dated November 16, 2010, which dismissed an appeal from a judgment of conviction of the District Court of Nassau County, First District, rendered June 28, 2010.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is granted and the appeal shall be perfected by April 1, 2011.
