DECISION & ORDER ON MOTION

Motion by appellant to vacate an order of this court dated July 15, 2010, which dismissed an appeal from a judgment of conviction of the Criminal Court of the City of New York, Kings County, rendered February 20, 2010, and for leave to reargue so much of an order of this court dated April 23, 2010 as denied appellant's application for the assignment of counsel.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion seeking to vacate the order of dismissal is granted and the appeal shall be perfected by April 1, 2011; and it is further,
ORDERED that the branch of the motion seeking leave to reargue so much of the order dated April 23, 2010 as denied appellant's application for the assignment of counsel is denied.
