Motion by respondent on an appeal from a judgment of the Civil Court of the City of New York, Kings County, entered January 25, 2010, for an order directing the release of funds on deposit and for other relief.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED, on the court's own motion, that the appeal is dismissed for lack of prosecution; and it is further,

ORDERED that respondent's motion is denied without prejudice to respondent's moving in the Civil Court for the relief sought.
