| DECISION & ORDER ON MOTION |
Motion by the respondent pro se on an appeal from an order of the Supreme Court, Richmond County, dated October 9, 2009, to waive the requirements of 22 NYCRR 670.10.2(f) regarding certification of the respondent's appendix, and for an award of an attorney's fee. Separate motion by the respondent, inter alia, to impose a sanction upon the appellant's counsel.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to waive the requirements of 22 NYCRR 670.10.2(f) regarding certification of the respondent's appendix is granted; and it is further,
ORDERED that the branch of the motion which is for an award of an attorney's fee and the separate motion, inter alia, to impose a sanction upon the appellant's counsel are denied; and it is further,
ORDERED that on the Court's own motion, the appellant's time to serve and file a reply brief is enlarged until March 21, 2011, and the reply brief, if any, shall be served and filed on or before that date.
