DECISION & ORDER ON MOTION
| Joan Karagiannis, Respondent, v Doreen Nasar/Hyer, Appellant, "John Doe" and "Jane Doe", Undertenants. |
Motion by appellant for an enlargement of time to perfect an appeal from orders of the Civil Court of the City of New York, Queens County, entered October 7, 2009 and March 29, 2010, and to continue a stay granted by decision and order of this court dated July 9, 2010. Cross motion by respondent to vacate the stay and for other related relief.
Upon the papers filed in support of the motion and the cross motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion by appellant seeking to continue the stay granted by the decision and order of this court dated July 9, 2010 is granted on condition that appellant perfects the appeal by April 1, 2011; and it is further,
ORDERED that in the event that the above condition is not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on three days' notice; and it is further,
ORDERED that the branch of the motion seeking an enlargement of time to perfect the appeal is granted and the appeal shall be perfected by April 1, 2011; and it is further,
ORDERED that the cross motion by respondent is denied.
