DECISION & ORDER ON MOTION

Motion by the respondent to vacate a stay of enforcement of an order of the Family Court, Orange County, dated September 21, 2010, pending hearing and determination of an appeal therefrom.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is dismissed for failure to effect service in accordance with the terms of the order to show cause.
