DECISION & ORDER ON MOTION

Motion by the appellant for leave to reargue his prior application for a writ of error coram nobis to vacate, on the ground of ineffective assistance of appellate counsel, a decision and order of this Court dated January 25, 1988 (People v Fisher, 136 AD2d 729), affirming a judgment of the County Court, Orange County, rendered November 3, 1983, which was determined by decision and order of this Court dated September 28, 2010.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied.
