| DECISION & ORDER ON MOTION |
Motion by the defendants third-party plaintiffs-respondents to enlarge the time to serve and file a brief on an appeal from an order of the Supreme Court, Queens County, dated December 10, 2009. Application by the third-party defendant-respondent pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motion and the application, and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion and the application are granted, the respondents' time to serve and file their respective briefs is enlarged until April 28, 2011, and the respondents' briefs must be served and filed on or before that date; and it is further,
ORDERED that the third-party defendants-appellants' reply brief, if any, shall be served and filed in accordance with the rules of the Court (see 22 NYCRR 670.8[b]).
