DECISION & ORDER ON MOTION

Motion by the petitioner for leave to appeal to this Court from an order of the Family Court, Queens County, dated October 28, 2010, to stay enforcement of stated portions of the order pending hearing and determination of the appeal, for leave to prosecute the appeal as a poor person and for the assignment of counsel.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is dismissed for failure to serve the order to show cause in accordance with its terms.
