Application by the respondent-appellant pursuant to 22 NYCRR 670.8(d)(2) on an appeal and cross appeal from an order of the Supreme Court, Queens County, dated August 10, 2010, to enlarge the time to perfect its cross appeal.
Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is denied as premature as the appellant-respondent has not served and filed a brief and has been granted an enlargement of time to perfect the appeal until May 2, 2011 (see 22 NYCRR 670.8[c][3]).
