| DECISION & ORDER ON FOR REINSTATEMENT |
Motion by Kathleen Paolo for reinstatement as an attorney and counselor-at-law. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on March 15, 1978, under the name Kathleen Marcel Paolo. By order of this Court dated February 17, 1987, the respondent was disbarred based on her conviction of grand larceny in the second degree, in violation of former Penal Law § 155.35, a class D felony, and conspiracy in the fifth degree, in violation of Penal Law § 105.05, a class A misdemeanor, and her name was stricken from the roll of attorneys and counselor-at-law. The respondent's felony conviction was subsequently set aside by the New York State Court of Appeals (see People v Paolo, 73 NY2d 596).
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is held in abeyance and the matter is referred to the Committee on Character and Fitness to investigate and report on the respondent's current fitness to be an attorney.
