Cox, Esq. dated March 3, 2011, the affidavit of Gustave J. Detraglia, III, Esq. sworn to March 17, 2011, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the notice of appeal filed at the Oneida County Clerk's Office on July 26, 2010 and served upon the District Attorney on July 27, 2010 is hereby deemed timely filed and served.
