| DECISION & ORDER ON MOTION |
Motion by the appellant on appeals from a warrant of arrest of the Supreme Court, Putnam County, dated January 10, 2011, which was dismissed by decision and order on motion of this Court dated March 8, 2011, and an order of the same court dated February 10, 2011, for leave to appeal to this Court from the warrant of arrest and the order, to stay all proceedings in the above-entitled action, and to recuse Justice Francis A. Nicolai.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,
ORDERED that the motion is otherwise denied as academic.
