DECISION & ORDER ON MOTION

Motion by the petitioner for leave to reargue his prior motion for leave to appeal to this Court from an order of the Appellate Term of the Supreme Court, Second, Eleventh, and Thirteenth Judicial Districts, dated May 13, 2010, which affirmed an order of the Civil Court, City of New York, Queens County, dated June 23, 2008, which motion was determined by decision and order on motion of this Court dated August 6, 2010, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order on motion of this Court dated August 6, 2010, and for poor person relief.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the branch of the motion which is for poor person relief is granted to the extent that the motion filing fee is waived; and it is further,

ORDERED that the motion is otherwise denied.
