Motion by the appellant, in effect, to recall and vacate so much of a decision and order on motion of this Court dated January 20, 2011, as dismissed an appeal from an order of the Supreme Court, Westchester County, dated June 8, 2009, or, in the alternative, to direct the Supreme Court, Westchester County, to enter judgment upon the order dated June 8, 2009.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
