| DECISION & ORDER ON MOTION |
Application by Stephen W. Berger, on an appeal from an order of the Supreme Court, Westchester County, dated July 21, 2009, in effect, to substitute Stephen W. Berger, as special administrator of the estate of Naomi E. Sharrow, for the deceased defendant-respondent Naomi E. Sharrow.
Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is granted, and Stephen W. Berger, as special administrator of the estate of Naomi E. Sharrow, is substituted for the deceased defendant-respondent Naomi E. Sharrow; and it is further,
ORDERED that on the Court's own motion, the respondents' time to serve and file their briefs is enlarged until May 2, 2011, and the respondents' briefs, if any, must be served and filed on or before that date.
