Respondent-appellant having moved for an extension of time to perfect the appeals taken herein from orders of the Family Court, Cattaraugus County, entered in the Office of the Clerk of said Court on March 15, 2010 (CAF 10-00912), and March 29, 2010 (CAF 10-00913),

Now, upon reading and filing the affidavits of Michael J. Saglimben, Esq., sworn to February 15, 2011, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that with respect to the appeal taken from the order of Family Court entered March 15, 2010, the motion is denied and the appeal is dismissed (see Matter of Loki C., et al., __ AD3d __ [Mar. 25, 2011]), and

It is further ordered that with respect to the appeal taken from the order of Family Court entered March 29, 2010, the motion is dismissed on the ground that the appeal was dismissed by virtue of appellant's failure to perfect by the deadline set forth in the order of this Court entered November 4, 2010.
