The People of the State of New York, Respondent, v Ollie F. Missouri, Appellant.

Motion by appellant for leave to prosecute an appeal from a judgment of conviction of the District Court of Nassau County, First District, rendered April 21, 2010, as a poor person, and for the assignment of counsel.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is denied.

The appeal was dismissed by order of this court dated December 14, 2010, and appellant has failed to move to vacate the dismissal of the appeal. Appellant has also failed to provide this court with financial information necessary to determine whether defendant is indigent, specifically the amount of his and his wife's monthly income from all sources, including any welfare and/or Social Security payments that either he or his wife receives.
