Appellant having moved to extend the stay of sentence pending the appeal from the judgment of Genesee County Court, rendered January 4, 2010, and for other relief,
Now, upon reading and filing the affidavits of Alexis Oberlander sworn to March 7, 2011 and March 17, 2011, the notice of motion with proof of service thereof, the affirmation of David E. Gann, Esq. dated March 16, 2011, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted to the extent that the stay granted by Justice Peradotto is extended on the condition that the appeal is perfected on or before June 1, 2011, and
It is further ORDERED that appellant perfect the appeal on or before June 1, 2011, and in the event of failure to so perfect, the appeal is hereby dismissed without further order.
