Motion by the appellant-respondent James Cataldo, inter alia, for leave to reargue an appeal and cross appeal from a judgment of the Supreme Court, Nassau County, entered March 31, 2009, which were determined by decision and order of this Court dated February 1, 2011, and "for an assessment of damages" against the respondent-appellant.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied, with $100 costs.
