| DECISION & ORDER ON MOTION |
Motion by the appellants on an appeal from an order of the Supreme Court, Suffolk County, dated November 30, 2010, to confirm that enforcement of the provisions of the order which directed them to file their answer to the second amended verified complaint within 20 days of service upon them of a copy of the order with notice of entry and which directed them to appear for a preliminary conference on January 12, 2011, are automatically stayed pending hearing and determination of the appeal pursuant to CPLR 5519(a).
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to confirm that enforcement of the provision of the order which directed the appellants to appear for a preliminary conference on January 12, 2011, is automatically stayed pending hearing and determination of the appeal is denied as academic, as that date has passed; and it is further,
ORDERED that the motion is otherwise denied.
