It is Ordered that the motion and cross motion are consolidated for disposition. It is further Ordered that defendants-respondents' motion and cross motion to dismiss the appeal is granted, unless plaintiffs-appellants perfect their appeal by no later than the September 2011 term - the filing deadline is July 6, 2011. In the event of plaintiffs-appellants' failure to comply with the foregoing condition, defendants-respondents may move on five days' notice for an order dismissing the appeal.
