Motion by the appellant pro se to relieve counsel assigned to prosecute an appeal from a judgment of the County Court, Suffolk County, rendered April 17, 2009, and for assignment of new counsel.

ORDERED that the motion is denied without prejudice to seeking leave to file a supplemental brief after assigned counsel files a brief.
