The People of the State of New York, Respondent, v David Mion, Appellant.

Application by appellant for leave to prosecute an appeal from a judgment of conviction of the City Court of Rye, Westchester County, rendered February 3, 2011, as a poor person, and for the assignment of counsel.

Upon the papers filed in support of the application and no papers having been filed in opposition thereto, it is

ORDERED that the application is denied without prejudice to renewal upon furnishing this court with proper papers.

Appellant has failed to furnish this court with the financial information necessary to determine whether he is indigent.
