Appellants Ellen B. Sterman and Craig Chertack having moved to extend their time to perfect the appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Erie on July 29, 2010, and to consolidate the appeals from said order,
Now, upon reading and filing the affidavit of Michael J. Kanaley, Jr. Esq. sworn to April 19, 2011, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks an extension of time for appellants Ellen B. Sterman and Craig Chertack to perfect their appeal is granted to the extent that appellants Ellen B. Sterman and Craig Chertack shall perfect their appeal on or before June 20, 2011, and, in the event of failure to so perfect, their appeal is hereby dismissed without further order, and
It is further ORDERED that the motion insofar as it seeks to consolidate the appeals from the order entered July 29, 2010, is dismissed as unnecessary because the appeals were already consolidated by this Court's order entered April 28, 2011.
