Application by Tom A. Rizos, on an appeal from an order of the Supreme Court, Queens County, dated March 20, 2009, to substitute Tom A. Rizos, as independent administrator of the estate of Konstanto Rizos, for the deceased respondent Konstanto Rizos, and pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief.
Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is granted, and Tom A. Rizos, as independent administrator of the estate of Konstanto Rizos, is substituted for the deceased respondent Konstanto Rizos, and the caption is amended accordingly; and it is further,
ORDERED that the respondent's time to serve and file a brief is enlarged until June 6, 2011, and the respondent's brief must be served and filed on or before that date.
