| DECISION & ORDER ON MOTION |
Motion by Elliot Vayner, inter alia, for leave to appeal to this Court from two orders to show cause of the Supreme Court, Richmond County, dated September 23, 2010, and March 22, 2011, respectively, and, in effect, to stay enforcement of the temporary restraining orders contained in the order to show cause dated March 22, 2011, pending hearing and determination of the appeals.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to appeal to this Court from the order to show cause dated March 22, 2011 (Appellate Division Docket No. 2011-03619), is granted; and it is further,
ORDERED that the branch of the motion which is to stay enforcement of the temporary restraining orders contained in the order to show cause dated March 22, 2011, is granted, and enforcement of the temporary restraining orders contained in the order to show cause dated March 22, 2011, is stayed pending either hearing and determination of the appeal from that order to show cause or determination by the Supreme Court, Richmond County, of the motion brought by that order to show cause, whichever occurs first; and it is further,
ORDERED that the motion is otherwise denied.
