ORDER ON APPLICATION

Application by the respondents Rieco Properties, Inc., Framitz, Inc., Michael Petracca, Joseph Defigueroa, and Joseph Defigueroa, Jr., pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief on an appeal from an order of the Supreme Court, Nassau County, entered December 15, 2010. Application by the appellants to enlarge the time to serve and file a reply brief.

Upon the papers filed in support of the applications and the papers filed in opposition and in relation thereto, it is

ORDERED that the application by the respondents Rieco Properties, Inc., Framitz, Inc., Michael Petracca, Joseph Defigueroa, and Joseph Defigueroa, Jr., is granted and the time of the respondents Rieco Properties, Inc., Framitz, Inc., Michael Petracca, Joseph Defigueroa, and Joseph Defigueroa, Jr., to serve and file a brief is enlarged until May 13, 2011, and the brief of the respondents Rieco Properties, Inc., Framitz, Inc., Michael Petracca, Joseph Defigueroa, and Joseph Defigueroa, Jr., must be served and filed on or before that date; and it is further,

ORDERED that the application of the appellant is denied as premature as the respondents Rieco Properties, Inc., Framitz, Inc., Michael Petracca, Joseph Defigueroa, and Joseph Defigueroa, Jr., have not served and filed a brief.
