Motion by the respondent Mark B. Lew to impose a sanction upon the petitioner and for an award of an attorney's fee in a proceeding pursuant to CPLR article 78 in the nature of a writ of mandamus, which was withdrawn by an order on application of this Court dated December 13, 2010.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
