Appellant having moved for permission to proceed as a poor person and assignment of counsel on the appeal taken herein from an order and judgment of the Supreme Court entered in the Office of the Clerk of the County of Oneida on May 12, 2010,

Now, upon reading and filing the affidavit of Joann Kasby sworn to April 1, 2011, the notice of motion with proof of service thereof, and the affirmation of Christopher G. Todd, Esq. dated April 14, 2011, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed because the appeal was dismissed by the order of this Court entered August 16, 2010.
