| DECISION & ORDER ON MOTION |
Motion by the appellant on an appeal from a judgment of the Supreme Court, Nassau County, entered December 14, 2010, in effect, to amend so much of a decision and order on motion of this Court dated January 20, 2011, as stayed enforcement of so much of the judgment, inter alia, as conditionally committed him to the Nassau County Correctional Facility, upon the perfection of the appeal on or before April 20, 2011. Separate motion by the respondent for leave to renew her opposition to the appellant's prior motion for poor person relief and the assignment of counsel, which was determined by decision and order on motion of this Court dated March 4, 2011.
Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is
ORDERED that the appellant's motion is granted, and the decision and order on motion of this Court dated January 20, 2011, is amended by deleting from the decretal paragraphs thereof the date "April 20, 2011," and substituting therefor the date "June 27, 2011"; and it is further,
ORDERED that the respondent's motion is denied.
