ORDER TO SHOW CAUSE

Motion by counsel assigned to prosecute an appeal from an order of the Criminal Court of the City of New York, Queens County, entered January 4, 2010, in effect, to be relieved of the assignment on the ground that the appeal from the order entered January 4, 2010, designating appellant a level 2 sex offender, has been rendered moot by appellant's subsequent adjudication, in an unrelated prosecution, as a level 3 sex offender, and on the further ground that appellant has been deported.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED, on the court's own motion, that the appeal is dismissed as moot; and it is further,
ORDERED that assigned counsel's motion is granted and assigned counsel is relieved.
