Now, upon reading and filing the affirmation of Charles D. Halvorsen, Esq., dated April 6, 2011, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the notice of appeal filed January 7, 2011, shall be treated as valid as to the order of Family Court entered January 5, 2011, under Family Court Docket Nos. B-19296-09 and B-19297-09, and

It is further ORDERED that the motion is granted and the appeal is dismissed.
