| DECISION & ORDER ON MOTION |
Motion by the respondent for an expedited briefing schedule on an appeal from an order of the Surrogate's Court, Nassau County, dated February 18, 2011, and for a preference in the calendaring of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for an expedited briefing schedule is granted and the appellant shall perfect the appeal on or before July 25, 2011; and it is further,
ORDERED that the respondent shall serve and file a brief, if any, on or before August 24, 2011; and it is further,
ORDERED that the appellant shall serve and file a reply brief, if any, on or before September 6, 2011; and it is further,
ORDERED that the branch of the motion which is for a preference in the calendaring of an appeal is denied.
