DECISION & ORDER ON MOTION

Motion by Carol Schajer, counsel assigned to represent the appellant by the Supreme Court, Kings County, to be relieved of the assignment on an appeal from an order of the Supreme Court, Kings County, dated January 26, 2011, and for the assignment of new counsel.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is denied as unnecessary as new counsel was assigned by decision and order on motion of this Court dated May 9, 2011.
