Respondent-appellant having moved for permission to proceed as a poor person and for assignment of counsel on the appeal taken herein from an order of the Family Court, Oneida County, entered in the Office of the Clerk of said Court on January 10, 2011,

Now, upon reading and filing the affidavit of Kristine E., sworn to May 3, 2011, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied with leave to renew upon the submission of a new motion that includes an affidavit addressing the question of whether appellant's spouse provides her and their children with financial support, and, if so, setting forth his current gross income from all sources as well as his assets and financial obligations.
