Defendant having moved pursuant to CPL 460.30 to extend the time to take an appeal from a judgment of the Supreme Court, Erie County rendered February 19, 2010,
Now, upon reading and filing the affidavits of Reginald Taylor sworn to April 26, 2011, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks CPL 460.30 relief is dismissed as untimely, and
It is further ORDERED that the notice of appeal filed and served on February 19, 2010 shall also be treated as a valid instrument as to the judgment rendered February 19, 2010 under indictment number 2006-1055 pursuant to CPL 460.10(6), and It is further ORDERED the appeal herein may be prosecuted upon one record as defined by 22 NYCRR 1000.3 (c)(1) and ten copies of the appellant's brief, reproduced in accordance with 22 NYCRR 1000.4 (f), and
