DECISION & ORDER ON MOTION

Motion by the respondent Richard F. Daines to enlarge the time to serve and file a brief in a proceeding pursuant to CPLR article 78, which was transferred to this Court by order of the Supreme Court, Nassau County, dated May 3, 2010.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted and the time of the respondent Richard F. Daines to serve and file a brief is enlarged until July 6, 2011, and that respondent's brief shall be served and filed on or before that date.
