Motion by Mattituck Development Corp. on an appeal from an order of the Supreme Court, Suffolk County, dated April 21, 2011, to vacate a preliminary injunction contained in the order dated April 21, 2011, for leave to appeal to this Court from an order of the same court dated April 26, 2011, and to vacate a temporary restraining order contained in the order dated April 26, 2011.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that on the Court's own motion, the appeal purportedly taken as of right from the order dated April 26, 2011 (Appellate Division Docket No. 2011-04766), is dismissed, without costs or disbursements (see CPLR 5701).
