Application by Galen D. Kirkland in a hybird proceeding pursuant to CPLR article 78 and Executive Law § 298, which was transferred to this Court by an order of the Supreme Court, Westchester Couny, entered December 1, 2010, pursuant to 22 NYCRR 670.8(d)(2), in effect, to enlarge the time to serve and file a record or appendix and brief in support of his cross petition in the event that Wolfson Casing Corporation does not serve and file a record or appendix and brief in support of its petition.
Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is denied as academic as Wolfson Casing Corporation served and filed its appendix and brief on June 1, 2011.
