The People of the State of New York, Plaintiff, v Brian C. Moffett, Defendant.

Motion by defendant, pursuant to CPL 460.30, in effect, for an extension of time to take an appeal from a judgment of conviction of the Justice Court of the Town of Poughkeepsie, Dutchess County, rendered December 14, 2009.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is denied, as an extension of time for taking an appeal may only be granted up to a maximum of one year and thirty days after sentencing (see CPL 460.30).
