Petitioner having moved for an extension of time to file and serve briefs on two separate CPLR article 78 proceedings transferred to this Court by orders of the Supreme Court entered in the Office of the Clerk of the County of Monroe on August 5, 2009, and December 9, 2009,

Now, upon reading and filing the affidavit of Jessie J. Barnes sworn to April 28, 2011, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks an extension of time to file and serve a brief in Docket No. TP 11-00161 is granted on the condition that petitioner's brief is filed and served on or before July 12, 2011, and the Clerk is directed to accept the brief for filing, and

It is further ORDERED that respondent's brief in Docket No. TP 11-00161 shall be filed and served on or before August 16, 2011, and the Clerk is directed to accept the brief for filing, and

It is further ORDERED that the motion insofar as it seeks an extension of time to file and serve a brief in TP 10-00523 is granted on the condition that petitioner's brief is filed and served on or before July 15, 2011, and the Clerk is directed to accept the brief for filing, and

It is further ORDERED that respondent's brief in Docket No. TP 10-00523 shall be filed and served on or before August 19, 2011, and the Clerk is directed to accept the brief for filing.
