Motion by Edward P. Mangano, Peter J. Schmitt, John J. Ciotti, Denise Ford, Francis X. Becker, Jr., Howard J. Kopel, Vincent T. Muscarella, Richard J. Nicolello, Norma L. Gonsalves, Joseph V. Belesi, Dennis Dunne, Sr., Rose Marie Walker, William J. Muller, the Nassau County Legislature, and the County of Nassau, joined by Louis G. Savinetti, for leave to appeal to this Court from an order to show cause of the Supreme Court, Nassau County, dated May 31, 2011, in effect, to stay enforcement of a temporary restraining order contained in that order to show cause pending hearing and determination of the appeal, and for summary reversal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branches of the motion which are for leave to appeal and, in effect, to stay enforcement of the temporary restraining order are granted, and enforcement of the temporary restraining order contained in the order to show cause dated May 31, 2011, is stayed pending hearing and determination of the appeal; and it is further,
ORDERED that the motion is otherwise denied.
